GENERAL TERMS AND CONDITIONS OF SALE

1. Scope of Application

These General Terms and Conditions of Sale apply to all orders placed through our online shop by consumers and private customers.

A “consumer” is any natural person acting for purposes unrelated to their commercial, entrepreneurial, or professional activity.

The presentation of products in the online shop does not constitute a binding offer, but an invitation for the customer to submit an order.

By placing an order, the customer submits a binding offer to purchase.
The contract is concluded upon our order confirmation sent via email or upon shipment of the goods.

3. Prices and Shipping Costs

All prices are indicated in Euro (€) and include applicable VAT, where required.

Any shipping costs are displayed separately during the checkout process.

4. Delivery

Delivery is made to the address provided by the customer.

Delivery times may vary between 3 and 8 working days.
In the event a product is unavailable, the customer will be informed promptly.

5. Payment

Payment is due immediately upon conclusion of the contract.

The accepted payment methods are those indicated in the online shop.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Legal Warranty

The warranty provisions established under current European Union law apply.

8. Liability

We are liable without limitation in cases of intent or gross negligence.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations.

9. Applicable Law

Italian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the country in which the consumer habitually resides remain unaffected.

RIGHT OF WITHDRAWAL 

Right of Withdrawal

The consumer has the right to withdraw from this contract within fourteen (14) days without providing any reason.The withdrawal period expires fourteen days after the day on which the consumer, or a third party other than the carrier and designated by the consumer, acquires physical possession of the goods.

Exclusion or Early Loss of the Right of Withdrawal

The right of withdrawal does not apply in the following cases:
• goods that are liable to deteriorate or expire rapidly;
• sealed goods that are not suitable for return for health protection or hygiene reasons, and that have been opened after delivery.For food products (such as extra virgin olive oil or gourmet items), the right of withdrawal applies only if the product is intact, unopened, undamaged, and with its original seal fully intact.

Effects of Withdrawal

In the event of a valid withdrawal, we will refund all payments received from the consumer, including standard delivery costs, within fourteen days from the day we receive the withdrawal notice.The refund may be withheld until we have received the returned goods.

Return of Goods and Liability for Diminished Value

The consumer must return the goods without undue delay and in any case within fourteen days from the date of the withdrawal notice.The direct costs of returning the goods are borne by the consumer.The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.This applies in particular in the following cases:
• original packaging damaged or missing;
• transport damage resulting from insufficient packaging for the return shipment;
• food products that have been opened or lack their original seal.
